How can you stop debt collectors from calling you?
Category: FinanceYou are receiving endless calls from collection agencies at all hours of day and night and you are harassed by their rude behavior. In such a situation you need not panic as there is a solution to it - all you have to do to stop you from calling is to tell them that you prefer to communicate in writing. It is always advisable to have written communication with the debt collectors as it gives you a record of everything that is said to you. If the collector violates the FDCPA, then you have hard core proof of the violation that could lead to a lawsuit in your favor.
The surest way to stop debt collectors from calling and intimidating you is by sending them a cease and desist letter. Notify the collectors in the letter that you do not want any further communication and they should immediately stop all the collection efforts. However, note that the cease and desist letter only applies to debt collectors or collection agencies, not the original creditor.
Once the collection agency receives your cease and desist letter they can contact you once more, that too via mail to inform you about their future move. They can notify you about one of the three things that they can do:
They can terminate further efforts to collect the debt.
They can certain actionsto collect
Or they can move the account to legal status.
While you send the cease and desist letter to the debt collector, remember to send it via certified mail with return receipt requested. By doing so, you will have proof that the letter was actually sent and received by the debt collector. If the collector contacts you beyond the single instance allowed by the FDCPA, then this proof will allow you to seek legal action against the debt collector.
